Modulbank’s Former Top Managers Apologized and Revoked Claims against Artem Avetisyan, as Commented by Businessman’s Lawyer Philipp Ryabchenko.

Modulbank’s founders and former managers Andrei Petrov, Yakov Novikov and Oleg Laguta asked the Ethics Commission of the Russian Union of Industrialists and Entrepreneurs (RUIE) to revoke the complaint against Artem Avetisyan, the bank’s owner. RBC has a copy of the complaint addressed to David Yakobashvili, the Chairman of the Commission, and its authenticity was confirmed by RBC’s channel at Modulbank and an interlocutor at the RUIE.

The former founders informed the Chairman of the Commission in a letter that they had ended the corporate conflict with Avetisyan “amicably” after “long negotiations” on September 18. In this connection, Modulbank’s founders asked to stop proceedings in respect of the complaint against Avetisyan, “cancel the decision of the Arbitrators’ Committee on including Avetisyan in the list of unreliable partners and not to publish the decision of the arbitrators.” It is not mentioned on the RUIE website that such a decision has been made in respect of the owner of Modulbank, and the register of unreliable partners itself is not disclosed.

Avetisyan “has never been in the list of the RUIE and the decision on including him in the said list has never been made,” Philipp Ryabchenko, the businessman’s lawyer told RBC. The RUIE’s representative refused to comment on the Commission’s decision because “all information and documents relating to the consideration of the dispute are strictly confidential.”

Yakov Novikov also wrote on Facebook about a truce. “We were not right when we connected our personal issues relating to Modulbank and its shareholder with the theme of the corporate dispute and criminal case in respect of the managers of Baring Vostok,” he noted. Now, according to him, the former top managers “do not have any claims against either Modulbank or its shareholder.”

Avetisyan wrote on his Facebook page that he “had not commented on the situation because he knew that time would put everything in its place” and added that he “always liked the people who are not afraid to admit their mistakes.”
“We are very glad that the former top managers admitted their mistakes. At the same time, I underline that we have never had a goal to enter into any labor disputes with anybody,” the press office forwarded the words of Pavel Semenov, a member of the Board of Modulbank, to RBC. According to RBC’s channel who is familiar with the terms and conditions of the settlement agreement, it is forbidden for the parties to disclose its details.
